GRANDPARENTS’ VISITATION RIGHTS

Children are not the only ones who can suffer as a result of their parents’ divorce. Grandparents often find themselves locked out of their grandchildren’s lives when their children divorce. While there are “grandparent visitation” statutes in all 50 states, they vary greatly. Some states have such restrictive visitation statutes that they force grandparents to get a court order for visitation if the child’s parents are divorcing or if one or both parents have died. Most states have more permissive visitation laws that allow their court to consider visitation requests even without the death of a parent or the dissolution of the family as long as visitation would serve the vest interests of the child.

By the same token, some parents may feel that contact with their grandparents may not be in their children’s best interests and in that case a court may not grant any contact.
